The Building and Zoning Department is located on the ground level of the Village Hall, located at 165 Mill Road, Westhampton Beach, New York 11978.

Mission Statement

The Village of Westhampton Beach is committed to the goal of responding to the needs of our residents with the highest level of efficiency possible. The Village strives to process all land-use applications in a prompt and courteous manner.

In a continuing effort to maximize the use of our resources and streamline the application process, the Village has implemented the following procedures to ensure that there is a clear and concise flow of information between the applicants, Village officials, appointed boards and those employees involved in the coordination and processing of land use applications. This document provides procedures for the intake and referral of Building Permits/Fire Prevention Permits and Applications submitted to the Architectural Review Board, Planning Board, and Zoning Board of Appeals. In order to achieve the goals set forth above the procedures do provide timetables for the various functions performed during the processing of all land use applications. The timetables are not intended to nor do they change the applicable legal timetables provided for in the law. Rather they are intended only as a means of ensuring that all applications are promptly acted upon.

  • Administers all department activities including New York State Building and Fire Codes as per Part 1203 of the NYS Uniform Code.
  • Administers the Coastal Erosion regulations (Chapter 74)
  • Administers Flood Plain regulations (Chapter 91)
  • Administers Zoning regulations (Chapter 197)
  • Reviews building permit applications, Planning Board applications and denial letters for Board of Zoning Appeals applications.
  • Attends Planning Board and Zoning Board meetings.

  • Prioritize and coordinate all permit application distribution for Building Department and Fire Prevention for processing.
  • Reviews and issues Building permits, Certificate of Compliance’s/Occupancies as required.
  • Prepares permit statistics, activity reports and financial statements as needed.
  • Responsible for scheduling appointments for Building Inspector and Fire Marshals.
  • Responsible for implementation/upkeep of forms/flyers/informational handouts available at front counter for easy public access.

  • Contact for complaint and information regarding Village and NYS code regulations.
  • Investigates and responsible for issuance of violations/summonses/Stop work orders
  • Issues sign permits, summer rental permits and updated certificates of occupancy

  • Completed NYSDEC endorsed 4-Hour Erosion and Sediment Control Training; Assists Stormwater Management Officer in monitoring outfalls, illicit discharge and compliance with approved Storm Water Pollution Prevention (SWPP) Plans as required under the Village’s Stormwater Chapter 149

  • Responsible to attend all official meetings of the Village of Westhampton Beach appointed Boards and to prepare official minutes of meetings.
  • Prepare/publish Zoning and Planning Board meeting agendas and notices under the direction of the Building Inspector, Village Attorney and Board Chairmen
  • Disseminate all application information to Zoning and Planning Board members, Building Inspector, Village Attorney, Village Planner, Village Engineer and other Village Staff
  • Refer applications to the Suffolk County Planning Board Commission and other involved agencies and Village Boards as required by the Village Zoning Code and Notify adjoining property owners of public hearings

  • As provided for in Chapter 70 (Building Construction and Fire Prevention) of the Village Code and part 1203 of the NYS Uniform code, the Fire Marshal conducts the following activities:
  • Investigates fire or explosion. Identifies any unsafe structures or equipment.
  • Issues Operating permits for hazardous materials, hazardous activities, pyrotechnic devices and buildings containing one or more areas of public assembly with an occupant load of 100 persons or more.
  • Conducts Fire safety and property maintenance inspections on all multiple dwellings and commercial businesses within the Village on a scheduled basis
  • Follows through on complaints and coordinates with the Building inspector and Ordinance enforcement officer when needed.

Fire Prevention Permits

Fire Prevention Permits will also be processed by the Building Department Staff. A complete list of permits and requirements are available at the Building Department. In addition to the required permits, yearly inspections are done by the Fire Marshal in all businesses and Places of Assembly.
